JOB DETAILS:
As the Global RECAP program has now entered a second phase, the Tanzania RECAP country team has requested an updated review of the relevant legal frameworks in priority policy areas, to include developments since the initial assessment was undertaken in 2019 and to inform activities planned in Tanzania and Zanzibar and supported under Global RECAP phase II.
The Provider is requested update the 2019 Desk Review on the following terms:
1. The starting point of the legal audit will be a review of the Global RECAP Needs Assessment Report by WHO and the Desk Review undertaken by WHO mapping the regulatory and policy framework in Tanzania and Zanzibar in 2019 (attached).
2. The Provider will update the WHO Desk Review by identifying any changes in the legal and policy framework from the initial assessment, including new or updated policies, additional or amended Legislation, Bills, Regulations or other subsidiary legislative instruments, Standards, Administrative or Executive Orders or Policies, at a National or sub-national level in Tanzania or Zanzibar, whether they are in force, in draft or otherwise in the process of development, publication or enactment
3. The updated Desk Review shall include such instruments listed above in a summarized in an appropriate format that are in force, in draft or otherwise in the process of development in Tanzania or Zanzibar.
4. The updated Desk Review shall incorporate any significant changes in relevant legal instruments or policies, responsibilities of regulatory agencies, governance mechanisms or multisectoral platforms.
5. The purpose of this consultancy therefore is to update a Desk Review of relevant legal and policy frameworks in Tanzania and Zanzibar which was undertaken by WHO in 2019 under the Global RECAP program. The updated Desk Review and accompanying report and source documents will support continued technical assistance in Tanzania on law, healthy diets and physical activity.
SCOPE & EXPECTED RESULTS
Objective 1: Delivery of an updated Desk Review mapping the regulatory and policy frameworks in Tanzania and Zanzibar relevant to the policy domains of: food labelling; restrictions on marketing of unhealthy foods; reformulation of food products; fiscal policies to promote healthy diets, including sugar-sweetened beverage taxes; and promotion of physical activity, to support government officials, regulators, policymakers, academia and civil society to understand, develop and implement (as appropriate) regulatory and fiscal measures that promote healthy diets and physical activity.
Output 1.1: Draft updated Desk Review delivered to WHO for comments
Output 1.2: Verification and validation of the findings of the updated Desk Review with the Tanzania RECAP country team and any other ministries or regulatory agencies identified in the Desk Review who are not represented on the RECAP country team
Output 1.3: Final updated Desk Review delivered to WHO and Tanzania RECAP country team
Objective 2: Summary of findings on updated legal and policy framework and provision of new or updated legal and policy instruments.
Output 2.1: Brief report (5-10 pages) summarizing key changes in the updated desk review from the 2019 WHO Desk Review and identifying any gaps in research or documents that are unavailable
Output 2.2: Collation and provision of copies of all new or updated policies, additional or amended Legislation, Bills, Regulations or other subsidiary legislative instruments, Standards, Administrative or Executive Orders or Policies, at a National or sub-national level in Tanzania or Zanzibar obtained while updating the Desk Review and/or commented on in the report
TIME FRAME
The assignment must be completed within one (1) month from the date of commissioning.
KEY COMPETENCIES AND EXPERIENCE REQUIRED
1. Strong knowledge of the legal system in Tanzania
2. Fluency in English and Swahili (verbal and written)
3. Excellent analytical and report writing skills
4. Good written, interpersonal, and facilitation skills
5. Work experience with the UN and/or International Organizations is desirable
MANAGEMENT PLAN
• The consultant will work closely with the Ministry of Health – Nutrition and NCDs focal persons; other relevant government Ministries, Agencies and Regulatory authorities and WHO focal point Tanzania Country Office. The Public Health Law and Policies (LAW) team at WHO HQ will also be available to provide specialized technical support to the consultant on request.
FUNDING SCOPE
• The total budget for the assignment must not exceed USD 5,000 including costs related to the consultancy, communication & travel as appropriate, stakeholder consultation and validation meetings
EDUCATION
• Essential: Bachelor (or equivalent) degree in law from an accredited/recognized institution entitling the candidate to practice law in Tanzania Mainland and/or Zanzibar
• Desirable: Post-graduate qualification or specialized training in (a) public health (b) nutrition (c) physical activity
EXPERIENCE
• Essential: At least five (5) years of experience practicing law in the Tanzanian legal system
